One of our clients received information that a civil penalty of £52,000 has been imposed on their transport company under the amended the Carriers’ Liability (Amendment) Regulations 2023.

  • From minor oversight to severe company’s financial problems

For the road transport company, which we will refer to as ALPHA, it was supposed to be a routine carriage of goods from France to the UK with nothing out of the ordinary. ALPHA has been in the transport industry for more than 15 years and has extensive expertise in providing goods to clients and ensuring their satisfaction. However, during a standard Border Force inspection, four stowaways were discovered hidden in the trailer. The driver was surprised when he found a small hidden hole in the roof of the trailer. The penalty is very severe, although the driver skipped only one spot while going through the security checklist. Under the new regulations, the line between intentionally transporting illegal migrants and doing so without proper due diligence is blurred. More importantly, the penalties are summarised, and the transport company is usually burdened with the payment of the fine. Failure to make the payment can lead to the seizure, detention, and sale of the vehicle to pay off the fine.
